Never thought about that. I rarely ride and when I do it is racing where everyone signs a release.
I really never ride hardly at all and when I do there is normally only the people I ride with there. I had a guy who worked for a ambulance chaser say that if you had insurance they would come after you and if you didn't the lawyer would not take the case as there would be nothing to go after. Being I just wrecked my motorcycle, all the health insurance wanted to know was did I have other coverage and since I didn't they paid. I have a hard time believing that if a person borrowed your UTV and they wrecked it they could collect on you, who would fight that case? If you filed on your insurance to fix it I bet your insurance company would go after them to pay for it. Either way it can be a ugly situation so don't loan it out and don't let others drive unless your with them and they are just taking it easy. Don't ride in a congested area either. Things are different here in the south I guess. Todd Last edited by Hunterworks; 07-06-2008 at 07:46 PM.. |

Well, That's where you being a business owner comes in. Since you have assets they could come after you, via a lawsuit. I would strongly look into having a meeting with your insurance agent as well as your lawyer and make sure you and your business are protected from the dirtbag lawyers and insurance companies. You don't want to take a chance of losing all that you work so hard for.

Never loan out your ride. Always carry liablity insurance in case you hurt your family member or friend riding with you. and if you have assets set up a trust. That way it is harder to get your assests if god forbid someone is hurt/killed and they sue. I have a business also and after talking with my insurance agent and lawyer my eyes were opened up to What-IF senario.
My two cents. |

After reading all the replies on this insurance or no insurance converstation, I have come to my conclusion,* I won't be letting anyone else use my machine. Friends or family, it doesn't matter.* The way everyone is sue happy these days is a shame..... One of the points I was trying to make about a Teryx or equivilant, is that these things are made to take her to the max, and most people will, until the tree stops them....this is the nature of the BEAST!!!Thanks !!Dennis

Here are my two cents. In this day and age where people are "sue happy" I see the potential of a nightmare if you lend your vehicle out and that person gets into an accident. If it is a single vehicle accident, than that is different as the proglem will be between you and your friend who you let drive.
In the case where the accident is between your vehicle and someone elses vehicle it could likely be much more complicated. Depending on the insurance company, some companies may tell you that it is not the driver that is covered but the machine, others may say it is the driver who is covered. The insurance company could claim that they will not cover it because they feel the other driver was not familiar with the vehicle, therefore, the driver will need to contact his insurance. The other issue I have with loaning my stuff out is that a lot of people don't respect other peoples stuff. Bottom line, it could get really messy in my opinion, but I am not the authority. Definately check with the company that issues the policy on the machine.
