Default who's to blame??

If you let someone take your Teryx for a spin and they crashed it and got hurt very badly, who would be liable? Let us say it was on public lands and the person was over 18 years of age. Could the nature of this vehicle , being an extreme machine made for extreme riding , make it almost a lethal weapons of sorts. I suppose what I'm getting at is should you loan your machine out , at all?? Does anyone have any opinions on this?? This is a what if situation, hasn't happened yet, just interested in some different opinions..

I always say the driver is the responsible one and sounds like he/she owes you a vehicle.

Point, never loan it out.

Talk to your insurance company. These things get complicated. Also let the person you lend it to know in advance that they are responsible to return it in the same condition they borrowed it in.

We have borrowed friends Rhino's in the past and it is well known amongst my group of friends that you are responsible for the machine if you borrow it. Having said that, make 100% sure you have insurance on your machine! If something goes bad and say he person borrowing it gets hurt, they WILL come after YOU first since it was YOUR vehicle they got hurt in.

It is not the persons choice but it will be their insurance company going after you and your insurance company. Insurance companies and Lawyers don't take friendships into account when they are protecting their company or their clients.

I agree with Jay that even if you don't have insurance to cover the damage to your machine(which would be advisable considering the cost of them), you should at least have liability coverage for bodily and/or property damage to others. I think it would be safe to assume your homeowner's insurance won't cover the liability with out a special rider attached to it. Attorneys/insurance companies don't rely on friendship or applied consent, therefore, best to have the coverage in writing.....erring on the side of being "overprotected" would be the safest. I apologize to any attorneys on here if it sounds like I'm practicing law without a license. Also, some attorneys have been known to reach the scene of the accident before the 1st responders.....so I've been told.

Not only do we have insurance on our ATV's but additional medical coverage on each one AND we have a $2 million umbrella policy to cover anything that the vehicle insurance won't cover.

Say someone borrows your machine, and they crash and are needing 24/7 care the rest of their life. If that persons family sues or their insurance company sues, you could run out of the insurance coverage on your vehicle easily, and then have to pay out of your own pocket. Since we have property and our own business we needed the umbrella policy.

As much as I think insurance is a scam, we consider our insurance agent a very valuable asset to our financial well being

I must be the stupid one, I don't have insurance on mine but I don't let anyone else borrow it or drive it.

Sounds like a ex-wife here, cheaper to kill them.

Todd, Say a friend goes with ya and for whatever reason he gets hurt pretty bad and can't work for a few months. He goes to the hospital and since it happened in your vehicle, the hospital or his insurance company will come after you.

Say you run into someone and kill them or they can no longer work for the rest of their life. You will be the one they sue, and they could take everything you own, your business, etc. Thats why insurance is so important

Cheaper to kill as long as ya don't get caught... Don't think I'd be able to do the time if I did

Yah Todd, I hate to say it but Jaybo is right again (just kidding Jaybo) I always had an umbrella policy to pick up wherever my other coverage left off when I was in business. I still carry a million just to protect real estate. On my previous post I meant implied consent, not applied consent (brain fart)
